Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Foundrien’s website, applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

Foundrien provides tools, content, and services related to building and operating digital products for founders and businesses. Features may change over time. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use.

We may refuse registration or cancel accounts that violate these Terms or create risk for other users or for us.

You agree not to misuse the Services. Prohibited conduct includes: violating law; infringing intellectual property or privacy rights; distributing malware; attempting unauthorized access; interfering with the Services; scraping or automated access that overloads our systems without permission; harassing others; or using the Services to build competing services through misuse of our proprietary materials.

We may investigate violations and cooperate with law enforcement as appropriate.

You retain rights to content you submit (“Your Content”). You grant Foundrien a worldwide, non-exclusive license to host, use, process, reproduce, and display Your Content solely to provide and improve the Services and as you instruct (for example publishing a site you build).

Foundrien’s name, logos, software, templates, and other materials we provide are owned by Foundrien or its licensors and are protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, or distribute our proprietary materials.

Unless otherwise agreed in a separate written agreement for your project, internet domains and related registrar or DNS arrangements provisioned as part of a product we create for you may be owned or controlled by Sitesfied, our partner company, as part of the standard delivery model for those products.

Specific rights to transfer, purchase, or delegate a domain can be addressed in your project agreement or order. Until then, you receive the right to use the deployed product in line with your subscription or contract with us. Nothing in this section limits your ownership of Your Content or your trademarks you provide.

Paid features, subscriptions, or project fees are described at checkout or in an order. Taxes may apply. Late or failed payments may result in suspension of paid features. Unless stated otherwise, fees are non-refundable except as required by law or expressly stated in writing.

You authorize us and our payment processors to charge your payment method for applicable fees.

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Foundrien disclaims all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted or error-free, or that defects will be corrected.

To the fullest extent permitted by law, Foundrien and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunities, arising from your use of the Services.

To the fullest extent permitted by law, our aggregate liability for claims arising from the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve (12) months before the claim or (b) one hundred euros (€100). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

You will defend and indemnify Foundrien against claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services in violation of these Terms, or your violation of law or third-party rights.

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to the Services or others, non-payment where applicable, or legal requirements.

Upon termination, certain provisions survive, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

These Terms are governed by the laws of Belgium, excluding conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in Belgium have exclusive jurisdiction for disputes arising from these Terms, subject to mandatory rights you may have as a consumer in your country of residence.

We may update these Terms. We will post the revised Terms and update the “Last updated” date. Continued use after changes become effective constitutes acceptance, except where applicable law requires explicit consent for material changes.
